On trial for swindling 244,000 euros from an elderly woman with mental deterioration in Tenerife



The Santa Cruz de Tenerife Prosecutor’s Office has requested five years in prison for a man accused of aggravated fraud, and the same for the manager of a nursing home, who is accused of aggravated misappropriation of 244,000 euros from an elderly woman with mental deterioration, who has died.

In the case of the man, the return of 22,200 euros is requested, while 222,000 is requested from the woman, amounts that they would have appropriated by taking advantage of the mental deterioration of the elderly woman, who was admitted to this residence located in Candelaria.

The trial will take place next week in the Provincial Court, after it was not possible to carry it out at the beginning of the year.

The Prosecutor’s Office reports that to get the money, the accused posed as his nephew, and thus managed to get him to give him his card and bank codes. From there, the accused made 61 ATM withdrawals worth 22,220 euros.

Almost simultaneously, whoever ran the residence also took advantage of this situation to the point of getting the victim to grant him special power before a notary to sell an apartment located in Adeje.

In this way he was able to collect the amount of 47,000 euros by check, which that day was deposited into the residence’s account.

The sale was made for a much lower value than the appraisal of the home, which was 120,000 euros, as the accused knew, says the prosecutor’s office.

Furthermore, the defendant, using the same method, managed to sell an apartment located in Arona for which she cashed two checks for 38,600 euros each and which was deposited into the same account.

In this case the price of the property amounted to 144,000 euros, much higher than what was received from the sale.

Once the facts came to light, the accused deposited 42,000 euros in the Court, and the victim, who was declared incapacitated, died shortly after, leaving her daughter as the sole heir.
