CCOO reports to the Labor Inspection the refusal of Tranvía de Tenerife to investigate an accident


The CCOO union has reported to the Labor Inspection the refusal of Metropolitano de Tenerife, the company that manages the tram on the island, to investigate the causes of an accident in which, in its opinion, two workers were at risk of suffering serious injuries. .

In the complaint, the union indicates that the Metropolitan Health and Safety Committee, with the authorization of the prevention delegates, called for an extraordinary meeting motivated by two traffic accidents on the tram that could cause serious damage to the health of two drivers. .

However, the person responsible for Quality, Safety and Environment, Lucas de la Torre, who also holds the position of president of the Safety and Health Committee, rejected said call citing “peregrine” interpretations of the current Internal Operation Regulations, according to CCOO.

Likewise, CCOO affirms that the manager of the entity, Pedro Ribeiro, indicated that the holding of said meeting was not appropriate as he understood that the investigation of traffic accidents is not the responsibility of this collegiate and joint participation body intended for regular consultation and periodically of the company’s actions in terms of risk prevention.

However, the union continues, accidents are likely to cause serious damage to the health of drivers (and, in fact, have already caused damage to these workers), the majority position of the Metropolitano de Tenerife workforce.

For the union, the actions of those responsible for the company could constitute a violation of the Occupational Risk Prevention Law, which states that “the Health and Safety Committee will meet quarterly and whenever requested by any of the representations in it. ”.

It also understands that the refusal of said meeting could contravene the internal operating regulations of the Health and Safety Committee of Metropolitano de Tenerife agreed upon between the parties during the negotiation of the agreement to end the strike last June.

CCOO considers that Management hinders the preventive work of the prevention delegates and the deliberation of the Safety and Health Committee regarding traffic accidents that are likely to cause serious damage to the health of drivers, the majority group of the Metropolitano de Tenerife.

This position motivated a complaint before the Provincial Labor and Social Security Inspection of Santa Cruz de Tenerife in December 2022, from which emanated a request sent to the company on June 2 to urge it not to hinder the preventive work of this body. , concludes CCOO.
