The Prosecutor’s Office requests 6 years in prison for a man for appropriating the money of his disabled sister in Tenerife



The Santa Cruz de Tenerife Prosecutor’s Office has requested six years in prison and the return of 88,350 euros for an alleged crime of misappropriation from the brother of a woman declared incapacitated, which allowed the accused to be in charge of managing her assets, as as it did between 2013 and 2019.

At the time, a Court appointed the woman’s husband as guardian, although this position was annulled almost immediately due to the impossibility of exercising it and it was granted to the brother.

Once he obtained this power, the investigated person began to seize all the money that the woman had and that she was receiving due to her disability, paying only some of her limited expenses and without ever being accountable to the court that appointed her guardian.

The Public Ministry accuses him of having appropriated the aforementioned amounts to the point that his authority to manage his sister’s assets was finally withdrawn.

The Prosecutor’s Office also requests the payment of a fine of almost 4,000 euros and the inability to exercise guardianship or guardianship for six years.

According to the indictment, at the time the woman was admitted to a hospital and the obligation was imposed on said center to report every six months on her condition and evolution.

Finally, it was the Institute of Socio-Health Care (IASS) of the Tenerife Cabildo that was granted the capacity to represent women once the irregularities began to come to light.

During the trial that will be held next week in the Provincial Court, the content of the brother’s writing in which he informed the Court of the death of the woman who, he said, had made a will, will be revealed.
