The former councilor of Granadilla de Abona, Nicholas Georgehas been acquitted by the Provincial Court of Santa Cruz de Tenerife of the crimes of prevarication and embezzlement of which he had been accused in a case that has lasted 17 years.
Nicolás Jorge, who was a member of the PSOE until an oral trial was opened against him, complying with the party’s own statutes, which forced him to abandon a historical militancy, has been the object of attacks during all this time due to his status as accused or investigated , which gives the judicial decision a special scope.
The events date back to 2006, when the councilor presented a motion to the plenary session in order to begin the procedures for the creation of infrastructures to receive the DTT signal in the municipality of Granadilla de Abona.
This meant hiring technical assistance for 87,000 euros. The Court considers that, in the first place, the motion is a mere political act and that the hiring depends on the Governing Board, in addition to the fact that there was an open call for the granting of technical assistance to which three companies applied.
The Chamber considers that, in no case, the action of the former councilor was “reprehensible and much less the result of a deliberate action”, in the same way that “he is not aware of illegal behavior or its unfair consequences”.
This regarding the possible crime of prevarication.
Regarding the embezzlement, the Court concludes that “the conditions are not met as to the fact that the money was destined for its purpose, which was the installation of the DTT antennas.”
