Agents of the Civil Guard have carried out an intervention in a warehouse in the municipality of Frontera, on the island of El Hierro, where more than a ton of phytosanitary products have been seized.
Specifically, members of the Nature Protection Service (SEPRONA) and the Cynological Service (dog guides) displaced from Madrid carried out an inspection at the beginning of this month in which they discovered various types of phytosanitary products classified as harmful, toxic or very toxic.
During the inspection it was found that the person responsible for phytosanitary products was not registered in the Official Register of Producers and Operators of Phytosanitary Defense Means (ROPO) of the Ministry of Agriculture, Fisheries and Food, the Civil Guard reports in a note.
The facts described constitute a violation of Law 43/2002, of November 20, on plant health, in accordance with Royal Decree 1050/2022, of December 27, which modifies Royal Decree 1311/2012, of September 14, which establishes the framework for action to achieve a sustainable use of phytosanitary products.
This infraction can lead to economic sanctions ranging between 3,001 and 120,000 euros, classifying it as a serious infraction.
Likewise, the situation also violates Law 7/2022, of April 8, on waste and contaminated soils for a circular economy, in accordance with Order APA/1610/2003, of June 17, which regulates the withdrawal of phytosanitary products. containing active substances excluded from the Community list.
This infraction is also considered serious and could lead to financial penalties ranging between 20,001 and 600,000 euros.
The Civil Guard has immobilized the products and has made them available to the competent authority that will determine the actions that will be carried out with the products.
