The complaint has been registered by the United Sí Podemos candidates for the Cabildo de Tenerife, Manuel Marrero, and the Adeje City Council, Gabriel González, who have previously informed the media that new documentation has been provided that had not delivered before the insular corporation.
Specifically, Manuel Marrero has assured that the Cabildo de Tenerife “had forgotten to attach” said documentation in the petition that the Environment Prosecutor had sent him at the time regarding “the damage caused” by the start of the works and the disappearance of plant species such as the sad viborina.
In his opinion, the presentation of this complaint before the Anti-Corruption Prosecutor “comes to close a circle” that should lead to the total suspension of the works of a project that corresponds, he said, with the thought of developmentalism of the 60s of the 20th century but not with the Tenerife of the future.
“There has to be a different model of tourism development, not one of looting and destroying the territory as has been done up to now”, has indicated the also regional deputy of Sí Podemos Canarias.
He also recalled that the visit made last week to Brussels by their formation and activists opposed to the project, The European Commission exposed that the Government of the Canary Islands, the Cabildo de Tenerife and the Adeje City Council are the bodies that must ensure that environmental legislation is complied with.
However, Manuel Marrero has specified that the Cabildo and the Ministry of Ecological Transition have issued the orders that have led to the precautionary suspension of the works “and the largest fine ever imposed in the Canary Islands for environmental reasons.”
The councilor of United Sí Podemos in the Adeje City Council, Gabriel González, has assured that since the beginning of the file in 2014 irregularities have been found “that threaten its declaration as a project of public interest”, something that in his opinion lacks justification .
González has indicated that in the various plenary agreements adopted by the Adeje City Council in support of Cuna del Alma, unfavorable reports from other supra-municipal bodies have been ignored, such as the environmental deficiencies of the project due to the lack of a correct environmental evaluation and a report of sustainability.
Also since 2014 it was warned that the area of Puertito de Adeje where the Cuna del Alma is intended to be built was conducive to the existence of archaeological sites, which was later corroborated by the Tegüico Association.
The complaint indicates that at no time has the general interest of the project been justified, but the private interest has been justified, since the procedure is initiated by the Adeje City Council at the request of the promoter company Segunda Casa Adeje SL.
For this, a specific modification of the General Planning Plan was approved, which entails “neither more nor less” than the disappearance of residential land and the unification of the sector as tourism, as well as the adaptation to this “physical reality” of the ravines and plots at the applicant’s discretion.
Already in October 2014, the General Directorate of Territorial Policy of the Government of the Canary Islands issued a resolution pointing out to the City Council the existence of irregularities and urging their rectification, but, according to Podemos, the consistory made changes without rectifying said errors, including non-compliance of the mandatory time of public exhibition.
He also talks about how the City Council and the promoter ignored the warnings of the Cabildo de Tenerife that the project did not have the regulatory archaeological prospecting, to add that the regional Executive also indicated that there was no report on municipal intervention, economic-financial study, economic sustainability or mobility study.
In June 2015, the governing council of the Cabildo de Tenerife conditionally informed the project that its recommendations on the environment and historical heritage were incorporated, and a month later an architecture company replied that qualified personnel had carried out an archaeological inspection. without finding any type of deposit, which, according to Podemos, has been shown to be false.
The complaint relates all the subsequent actions, until the works began on May 5, 2022 without having the mandatory environmental reports, and its stoppage by the Historical Heritage of the Cabildo de Tenerife after detecting “very serious” damage to the deposits, which in turn entails the transfer of the file to the General Directorate of Heritage of the regional Government, which imposes the maximum sanction on the promoter.
In October of last year it was found that the promoter failed to comply with said precautionary stoppage order and in November the Cabildo sent to the Santa Cruz de Tenerife Prosecutor’s Office documentation related to the works in which, according to Podemos, the report was omitted that the works they had continued against the suspension order issued by the island corporation.
