Justice orders that a street in Santa Cruz de Tenerife recover its previous name



The Contentious-Administrative Court of Santa Cruz de Tenerife has ordered that the street named Tolerancewhose name was changed in 2020 to Arquitectos Saavedra y Díaz Llanos, recovers its previous name.

The reason is that, according to the Court, the established procedure was not followed since the mayor, José Manuel Bermúdez, chose to make the change by decree.

In 2008, as a result of the application of the Historical Memory Law, the former mayor, Miguel Zerolo, was forced to change the name of this road, which was then called García Morato, along with that of some others in the city, although not all of it. those required by this legislation.

The Court ruled that on certain occasions the Mayor’s Office may carry out this type of name change, as allowed by the Special Regulations for Honors and Distinctions of the City Council, but only in “exceptional” circumstances that did not occur in this case.

Hence the annulment of the Decree, challenged by a neighbor from the street, who turned to the lawyer, Antonio Padilla to file the appeal.

In this case, the Court considers that the exceptional case and extraordinary causes that justify having resorted to this route are not justified and the essential procedures established for this type of procedure were omitted.

Those unfulfilled procedures are that a prior consultation has been carried out by the mayor to the political groups or the existence of a report that demonstrates that there was an urgency to take this step due to a citizen request.

Hence, the Court determines the annulment of the name change that will recover the previous one of Calle de La Tolerancia.
