He Council of Tenerife has sent the Prosecutor’s Office a report regarding the irregularities detected in the granting of the so-called “incentive redundancies” made in the Casino Playa de The AmericasCasino Taoro and Casino Santa Cruz from 2012 to 2019, when Canarian Coalition was in the insular government, without there being any record of any agreement or express authorization from the competent bodies or agencies. Specifically, the documentation and annexes submitted to the prosecution refer to incentivized redundancies that, according to the study carried out, “could be classified as false disciplinary dismissals and unfair administration” that led to the payment of 1,579,945 euros as compensation. In addition, it is the case that some workers came to collect “compensation greater than their annual salary, therefore exceeding the compensation for objective dismissal” through the conciliation procedure and without there even being a judicial resolution that forced thereto. From the moment the Cabildo de Tenerife was aware of this procedure, it has informed the management bodies of the Casino companies of all the steps that have been taken to clarify the facts. As detailed in the report, in the letters sent to each of the workers affected, the dismissals were classified as “disciplinary dismissals”, which led the workers to appeal the decision of the companies, going to the Arbitration and Conciliation Mediation Service (SEMAC), where the companies recognized the unfairness of the dismissal and offered compensation workers that in certain cases exceeded that corresponding to an objective dismissal.
In this sense, the report highlights the fact that this modus operandi It is repeated by several dozen workers who were laid off between 2012-2019, many of them close to retirement age who, in no case, resorted to the courts to obtain their compensation. The president of the Cabildo, Pedro Martín, recalls that already in the last audits carried out in the years 2015, 2016, 2017 and 2018, the Intervention area detected various irregularities in the dependent entities, which affected the hiring of personnel, the contracts with third parties and economic and financial management. To counteract this situation, the Cabildo de Tenerife has promoted during this term the preparation of specific internal instructions and procedures to guarantee that the different public entities comply with basic standards such as the Public Contracts Law (CSP), the statute Basic of the Public Employee and the General law of subsidies.
a smoke screen
The group of CC-PNC in the Cabildo de Tenerife considers the alleged labor irregularities “a smokescreen” that denounced the PSOE in the Casinos of Tenerife in the period 2012-2019. It is the sense of the communiqué of the nationalist formation to respond to the news. The Canarian Coalition recalls in this press release that the Boards of Directors of the Casinos Playa de Las Américas, Casino Taoro and Casino Santa Cruz “were made up of members of all political groups -CC, PSOE, PP and Sí Podemos Canary Islands– and that they did not authorize any operation. “The very report that they have transferred to the Prosecutor’s Office dismisses the responsibility of the Boards of Directors of the three casinos, with which we are before another firework of Peter Martin to divert attention”, says CC. The nationalists point out that “hiring and firing were done by management” and they understand that “it has always been done in accordance with current legislation.” In addition, they explain that “the report on incentivized redundancies to which the PSOE alludes analyzes the period 2019 and 2020 with Pedro Martín in charge of the Casinos. In other words, these practices that qualify as alleged irregularities have also occurred in his mandate”. CC-PNC explains that “the report on incentivized redundancies indicates that the compensation was paid below the cost of the objective dismissal, in which case, it would mean savings for the Casinos”. For the nationalists “we are facing another smokescreen from the PSOE to distract attention. Without going any further, This week the Cranes case was filed because there was nothing. Pedro Martín is desperate because he does not want to talk about the million-dollar losses that the Cabildo has suffered due to its disastrous management ”. The Canarian Coalition recalls that the PSOE paid 2.3 million for the dismissal of the 72 Ansina and Cidemat workers “when according to the law it could have cost approximately 1,030,000 euros. The PSOE paid more than double what was established for dismissing those professionals. Will they also take this case to the Prosecutor’s Office? Are they going to denounce themselves for having spent more than double to throw out 72 people in the midst of a pandemic and leave the elderly in Tenerife without activities?
