The area of Sustainable City and Planning of the Puerto de la Cruz Town Hall the process of notification of imminent ruin to the owners of the property has been completed iders building. This activates the two-month period in which the property must submit the demolition project for the property, located on Avenida Betancourt y Molina, and abandoned 31 years ago.

This was confirmed by the councilor responsible for the area, David Hernández, when asked by this newspaper about the state of this process, which has been “long and complex”, with personnel from the area dedicated almost exclusively to this task. , “but necessary to be able to continue advancing and allow the owners to recover the homes” that they lost 31 years ago when they were evicted because a report warned of a risk of aluminosis.

In the event that the property does not comply with this obligation, contemplated in the ruin decree issued on June 7 of this year, the City Council will have legal protection to assume the contracting procedure for the building demolition project, through subsidiary execution. of the actions ordered, as those affected were warned at the time. Hernández explains that “last June, in view of the technical and legal reports requested from the area, the decision was made to decree the imminent ruin of the property, assuming the commitments derived from this decision by the Consistory”.

The procedure began in March of this year, recalls the mayor. “After a long work of analysis of all the unfinished files that were operating in the area, I issued an order in view of the serious problem that continued to exist, to determine the situation in which the property was located, which would culminate in the declaration of imminent ruin of the same ”.

first actions

The first actions, such as the eviction and the fencing of the building, were executed by the City Council, given the lack of response from the property. With the property vacated, the Area proceeded to officially notify the declaration of imminent ruin and the obligations derived from it to all the owners.

The next step, according to the aforementioned decree, is the drafting of the demolition project, which must be submitted by the owners of the property within two months. In addition, prior to completing the drafting of the project, the drafting team could establish other urgent building protection measures such as propping, which ensures the previous work to be carried out on the structure.

Subsequently, as the property is “in a legal situation of consolidation” and its demolition is ordered by the Administration, reconstruction will be allowed with the same buildable area of the replaced building, as indicated by the Canarian urban legislation. “This process that we have started is a key step to begin to put an end to a historical problem and to improve the environment and living conditions in that area of the municipality,” Hernández stressed.
