The promoter of Cuna del Alma has described it as “disproportionate” the total stoppage of the works. For all these reasons, the promoter alleges the “inconsistency” between the paralysis decreed and preceding actions in identical cases, “permissive with the continuation of the works and the adoption of non-suspensive corrective measures”, these alternatives being admitted by the qualified environmental bodies and by the General Directorate for the Fight against Climate Change itself in other similar situations where They looked for alternative options.

The promoter of Cuna del Alma recalls that “the environmental impact assessment of the Punctual Modification of the PGO of Guía de Isora contemplates the presence of the sad viborina and the collection of seeds and their subsequent restitution is agreed” and adds that “the Ecological Impact Statementapproved by Cotmac for the construction project of a bypass on the section of the Santiago del Teide-Guía de Isora-Adeje highway, contemplates that corrective measures must be adopted, at the level of recommendations, in the presence of the sad snake, but in In no case is the suspension of the works imposed”.
In addition, it insists that the urbanization works of the Cuna del Alma project are public works of municipal ownership, like these cited examples that are also public. The allegations also indicate the “seriousness of the damages” derived from the actions of the General Directorate for the Fight against Climate Change that affect the municipality and the Island, such as the stoppage of hydraulic and road works that they were planned; the economic damages derived from this stoppage; and the risk of loss of investment legal security.
