SANTA CRUZ DE TENERIFE, Nov. 25 (EUROPA PRESS) –
The Fifth Section of the Provincial Court of Santa Cruz de Tenerife has lowered the sentence imposed on an alleged perpetrator of a crime of sexual abuse without prevailing, in application of Organic Law 10/2022, of September 6, on the integral guarantee of the sexual freedom, known as the Law of ‘only yes is yes’.
According to sources from the Superior Court of Justice of the Canary Islands (TSJC), the original sentence had imposed ten years in prison and, after reviewing it in application of the Law of ‘only yes is yes’, the sentence remains in nine years.
In principle, it would be the first case in the Canary Islands of effective review of a sentence under the new rule.
The Provincial Court of Santa Cruz de Tenerife has received some twenty procedures to be studied, although eight have been reviewed so far, of which only the aforementioned sentence has been reduced, according to sources from the Canary Islands Superior Prosecutor’s Office .
The same sources suggest that in the Provincial Court of Las Palmas the number of proceedings received for review is similar to that of Santa Cruz de Tenerife.
