The Planning Department of La Laguna published in the BOP the approval of a “new interpretive instruction” of the ordinance of the Special Plan for the Protection of the Historical Complex, “so that it is understood that the transit of vehicles with a weight greater than at 3.5 tons”, according to the publication, but only for municipal services, buses and works, adjusting to certain criteria.
It should be remembered that the current ordinance prohibits the circulation and parking of vehicles over 3.5 tons, both publicly and privately owned. However, “the request for authorizations is frequent” for its passage, since in certain cases “there are no technically viable alternatives”, the instruction states.
Likewise, it is argued that “since there are various references in the Special Protection Plan itself regarding the necessary management of loading and unloading, the transit of municipal services and public transport in buses, it can be affirmed that the objective of the management is not it is the limitation without any nuance of the traffic of heavy vehicles, but the necessary regulation of these according to criteria that guarantee the greatest protection of heritage assets and accessibility and enjoyment of public space by pedestrians”.
In addition, with regard to the conservation of protected heritage, “it must be considered that the actions require the use of means that, due to their own technical characteristics, it is not possible to carry them out with light vehicles”.
That is why, from the Urban Planning Department, a new instruction has been approved in which the transit of these vehicles is allowed only when they are for the provision of municipal services, passenger transport in buses and the use of means assistants during the execution of works.
Likewise, and in order to establish the criteria under which to authorize transit, the express justification of the technical impossibility of using light vehicles is established, that it be carried out in hours with less influx of pedestrians and that it be carried out at a speed not than 10 km/h in order to reduce vibrations in buildings. In addition, regarding the transit of buses, it is indicated that “the operator must justify that vehicles of the smallest dimensions and weight possible are used, being necessary the need to use electric vehicles.”
