The Provincial Prosecutor’s Office of Santa Cruz de Tenerife has filed a complaint against all the members of the Local Government Board of the City Hall of Santa Ursula for approving the license of a minor work of fiber optic trunking without the mandatory legal report from the secretary of the Northern Consistory.
This complaint has its origin in an appearance in the Prosecutor’s Office, in July 2022, by the municipal spokesman for the PP, Edward Suarezand will continue its legal process in a Court of La Orotava.
Justice will have to clarify in the future if in the Governing Board of December 3, 2021, any crime was committed when approving, by way of urgency, the license for the execution of the telecommunications channeling work in the Old Highway of La Corujera and the Guanche street.
The license had a favorable municipal technical report, but the secretary warned that the legal report did not appear in the file “As required by Law 4/2017 on Land and Protected Natural Areas of the Canary Islands.”
The agreement to grant this license was approved unanimously with the votes of the mayor, Juan Acosta (AISU)and the four mayors of his party who attended the aforementioned meeting: Santiago Pérez, José Manuel Amador, Janira Gutiérrez and María Efigenia González. The complaint indicates the possible commission of a crime of administrative prevarication, which carries a penalty of disqualification from employment or public office, in the event that it is proven in a trial.
