They arrest a resident of Puerto Naos for breaching the prohibition to access the area

SANTA CRUZ DE TENERIFE, Oct. 10 (EUROPA PRESS) –

Agents of the Civil Guard belonging to the Main Post of Los Llanos de Aridane have arrested a 37-year-old man, a resident of the Puerto Naos neighborhood, for repeatedly disobeying the instructions of the agents regarding the prohibition of permanence in the area for reasons safety and health protection

The events began yesterday morning, when this person was identified by Civil Guard agents while he was driving his vehicle when he appeared at the access control to the area delimited by the risk of gas emanation from Puerto Naos, at which time who informed the agents of his intention to access and spend the night at his home, located in the aforementioned health risk area.

The agents of the Civil Guard informed him of the prohibition to remain in the area in compliance with Decree 112/2018, of July 30, which approves the Special Plan for Civil Protection and Emergency Attention due to volcanic risk in the Community Autonomous Community of the Canary Islands (PevolcA).

During yesterday, the defendant received up to four more times the same instructions from the Civil Guard agents in which they urged him to leave his home and leave the risk area; however, in all of them he ignored, always communicating and without leaving his home, that he was going to spend the night there, since he considered that his life was not in any danger, thus repeatedly failing to comply with the orders of the agents based on a prohibition made by the competent authority in the matter.

Finally, when the defendant was about to leave his home after spending the day and night inside it, he was arrested by the agents as the alleged perpetrator of a crime of serious disobedience. The competent judicial authority has decreed the defendant’s release on charges.

According to what is established in article 556.1 of the current Penal Code: “Those who, without being included in article 550, resist or seriously disobey the authority or its agents in the exercise of their functions, or private security personnel, duly identified, who carry out private security activities in cooperation with and under the command of the Security Forces and Bodies”.
