Agents of the Civil Guard belonging to the Seprona of the Garajonay Detachment in La Gomera have initiated proceedings in which they investigate a 60-year-old Danish tourist for a crime related to the protection of flora and fauna by illegally capturing a Marlin fish protected by specific measures.
The Seprona agents began the investigation after the information provided by the citizen collaboration in which it was reported that they had seen how two people left the San Sebastián de La Gomera sports pier carrying in their hands what appeared to be a tail and a sword of Marlin fish (Makiara spp).
This species is subject to differentiated protection measures in recreational sea fishing (RD 347/2011, of March 11, which regulates recreational sea fishing in external waters, and OM of February 26, 1999), For this reason, it is mandatory to have an authorization granted by the Ministry of Agriculture, Fisheries and Food, specifically by the General Secretariat of Fisheries.
Thanks to the information provided by the witnesses and the steps taken by the agents during the investigation, they were able to identify both the two people who were carrying the aforementioned pieces of the Marlin fish and a third party who told the agents that he had been the one who had captured from his recreational fishing boat, specifying that after more than 4 hours since the animal “hooked” on the hook, it died on the surface, proceeding to remove its tail and sword, throwing the rest of the body of the marlin fish Sea.
Once the agents requested from the now investigated the various mandatory documentation related both to the fishing exercise in general and to the capture of the aforementioned species in particular, subject to specific measures, as well as that of the boat from which the fishing was carried out. capture, it was found that he lacked the aforementioned authorization for the capture of that specific species, which is why he is being investigated as the alleged perpetrator of a crime related to the protection of flora, fauna and domestic animals.
In accordance with the provisions of article 335.1 and 2 of the current Penal Code, framed in Chapter IV of Crimes Related to the Protection of Flora, Fauna and Domestic Animals, in relation to hunting and fishing of species subject to obtaining the due administrative title (permit/authorization), will be punished with a fine of four to eight months and disqualification from exercising the right to hunt or fish for a period of one to three years.
