The councilors of Urban Planning and Festivities of the City Council of La Laguna, Santiago Pérez and Badel Albelo, have been acquitted of the complaint for an alleged crime of threats presented by the fugitive councilor of Ciudadanos, Alfredo Gómez.

The sentence, made public this Friday, indicates that the expression “you’re going to shit clown”, which Pérez uttered to Gómez in a plenary session and which was recognized by the Government mayor in the session itself, has no criminal implication.

According to the magistrate, Celia Blanco, the phrase “does not announce any evil” nor is there any attempt to “exert pressure” or “frighten” the mayor and although she understands that it is a “vulgar and ordinary” and even “inappropriate” expression for Pérez’s cultural level is still colloquial. Thus, she insists that the phrase is “unfortunate” but does not constitute a crime.

In the case of Badel Albelo, who snapped at Gómez “if he weren’t a councilman, I would break you right here”, the judge understands that it is an indeterminate threat because he does not clarify what he was going to break apart from the fact that it is pronounced conditional.

In this way, he emphasizes that the intimidation is not “serious or credible” and regarding the expression “come on, let’s go outside”, which he supposedly uttered to Gómez, he affirms that it has been denied by the mayor of Fiestas and was not heard by witnesses either.

An appeal against the judgment may be filed with the Provincial Court.
