The Court of Instruction No. 5 of Santa Cruz de Tenerife has decided to archive the case against the former head of Civil Protection of the island capital, who was denounced on January 29, 2020 for an alleged crime of sexual abuse. The Provincial Brigade of the Judicial Police took statements from several witnesses who, according to the order, “denied having been touched by the investigator, as well as having seen him do it to others.” Likewise, the complainant, JFDA, stated that “he did not remember on which date he joined the group, but that, in any case, he was 17 years old and that from the first moment the investigated took advantage of when he was alone in the car to touching her thigh and crotch, without explicitly proposing to have sexual intercourse “.
In the same way, the former head of Civil Protection denied all the facts. According to the order, in the face of the contradictory versions and taking into account the result of the police investigation with the other volunteers, “there are not enough evidence to allow the investigation to continue, so that the perpetration of the crime does not appear duly justified. to decree provisional dismissal of the proceedings “.
The victims had a period of 20 days to appeal, time that has already elapsed, so the file of the case is final.
