The Examining Court number 1 of Las Palmas de Gran Canaria declares the provisional dismissal of the procedure opened to the Fernando Báez Santana, Father Báez, as a result of a complaint from the Public Prosecutor’s Office for the priest’s statements about the death of two girls from Tenerife, Ana and Olivia, by their father, Tomas Gimeno, and nullifies the agreed investigation procedures. In addition, these actions are declared terminated and the filing thereof is decreed. The order, which is not final and can be appealed within five days, was published on November 24.
The complaint filed by the prosecutor’s office, and that now it is temporarily archived, refers to the statements made by Father Báez on June 11 of this year on the Andresito and company program of the Radio Aventura Siglo XXI station, in which, when asked by the interviewer about the case of the two missing minors, he said :: “The comment is fundamentally that they are looking for two girls, who are with the father, if the father killed them because he said so, you will not see them or me again. Now they are looking for the two girls and the What? He is not a person, he is also not worthy of being sought? He is also a victim, of whom of mistreatment, of separation from justice, I don’t know. ”
Three days later, on June 14, on his Facebook account he addressed the same issue again and stated: “” If that marriage had been faithful, if that marriage had not been broken, those girls would be alive. -The lack of fidelity … for not following the old ways, the man put up with the women even if they went crazy, the women put up with their husbands even if they were drunk or dirty, not now, now you leave and you leave and of course and then these consequences come, you screw me, because I screw you, I kill your children, which is what you love the most … we give reasons for this to happen. ”
That same day, and on his Facebook wall, he criticized those who “dispatched themselves at ease” with Antonio, Ana and Olivia’s father, and also considered him a victim. In another Facebook account, Báez Santana reiterated the condition of victim of the father of the two girls, recalling that there are two mothers who were crying, that of the minors and that of the father.
In the order, the investigating judge indicates that the public prosecutor considers that the opinions issued or published by the accused justified the disappearance or death of the daughters of Tomás Gimeno and Beatriz Zimmerman by the first, because the mother had separated of the girls’ father, arguing that all this is due to situations of separation, because women do not put up with men, and because they change partners and separate their children from their parents. Accusations that father Báez categorically denied when he refused to justify the death of the minors because their parents had separated. On the contrary, he described Tomás Gimeno’s behavior as a one hundred percent murderer and considered that it would be aberrant to justify it. It also classified the girls’ mother, Beatriz Zimmerman, as another victim.
Therefore, the judge in his order decrees the provisional dismissal inasmuch as the perpetration of the crime is not duly justified that has given rise to the formation of the cause.
