According to the TSJC, said Council resolution, signed by the mayor of Public Services, Guillermo Díaz Guerra (PP), “seems to refer to the use of the public domain that has been occupied with tents and other facilities in the Plaza de la Candelaria, without legitimate prejudice to the right of assembly ”. Therefore, the Superior Court of Justice of the Canary Islands indicates that the appeal presented by the claim platform does not refer to the administrative act related to the right to assembly, which has been authorized by the Government Sub-delegation. In this sense, the TSJC has given a period of four days to hear the parties “on the inadmissibility of the special process because it is not adequate to prosecute the claim raised in the brief filing the appeal.”
The City Council ordered the removal of the booths because they “occupy the public thoroughfare without authorization and prevent the celebration of Christmas events and the work of cleaning services.” The Consistory is waiting for the TSJC to rule on the appeal presented by the Camp in order to proceed with the eviction.
