Bajo la Cuesta, in Candelaria: Five years of eviction and threat of demolition

A dozen families were able to return to the neighborhood in May 2018, but there are still another 30 without doing so / DA

On a night like yesterday five years ago, a hundred residents of Bajo la Cuesta, in Candelaria, had to sleep far from their homes, after the eviction order issued by a decree initiated in 2015 by the former mayor Gumersindo García, in the face of what was described as a situation of high risk of landslides.

A dozen families were able to return to their homes on May 28, 2018, after the security works on the part of the slope owned by Endesa, but there are still 32 outside their homes, pending that the company Dani Ran – owner of the slope – and Costs, or failing that the administrations, take charge of the 1.4 million euros that it would cost to insure the area. In Güímar, the City Council had no problems carrying out emergency works in Santa Lucía and Las Bajas, even with financial support in the first case from the Cabildo. In Candelaria it has not been like that.

Since that October 26, the residents began to mobilize, with daily whistles in front of the Consistory, with presence in the plenary sessions under the slogan Bajo la Cuesta lives and camping at the entrance of the closed neighborhood. Five years later, silence, exhaustion and despair reign, even disunity, as different lawyers are those who carry their interests, José Ortega and José Luis Langa, not only because of the eviction file, but also because of the The threat, once again, that they will have to lose their homes after notifying Costas of the initiation of the “repossession” of the public domain.

Langa affirms that, “although some neighbors have not presented allegations, it is not serious, because it is normal that they are rejected. It is an administrative file. When the instruction is developed, the normal thing is that it is resolved in the Contentious Court “, declared the lawyer, who details that” what is unheard of is that a provisional eviction takes five years. I do not understand how a judge allows this, with the economic and moral damage that it means for the neighbors ”. Costas is protected for the eviction in the law 22/1988, of July 28, which establishes that “the works and facilities built prior to the entry into force of this law, without the authorization or concession required in accordance with the legislation of Coasts then in force, they will be demolished when their legalization does not proceed for reasons of public interest ”.

Mari Brito, mayor of Candelaria, rules out that there is any project for Bajo la Cuesta / DA

The mayor of Candelaria insists that “we have tried to act to ensure the slope of Dani Ran and Costas, but we do not have favorable reports to request the concession of land from Costas nor Dani Ran has executed his part, and we are in a judicial process for a subsidiary execution ”.

Likewise, he confirmed that “Costas transferred the notifications of possession recovery to the City Council, because the reality is that these houses are in the public domain, but we are advising the neighbors before a process that will be long,” he predicted, in a battle, of the many , which he maintains with Costas.
