Inmobiliaria Betancor SA filed this appeal “against the declaration of non-compliance with the legal duties and obligations of the Opuntia urbanization project”, but both the municipal technicians and the councilors of all the parties have shown their outright rejection of the company’s claims.
The mayor of Land Management and Planning, Environment and Climate Change, Infrastructures, Public Transport and Security, Narciso Pérez (CC), explained that “it is not the first time that this matter comes to the plenary session. Already in August we addressed some of the resources that were being presented to the town hall by the Opuntia promoter for the execution of the guarantee for a breach of the urbanization works by the promoters for more than 12 years, such as and as it is perfectly accredited in the different technical reports ».
Narciso Pérez pointed out that «The positioning of the City Council of La Orotava has been clear from the first moment when requiring developers to comply with all urban planning obligations derived from this sector. After more than 12 years of inactivity, we had to execute that guarantee to finish the green areas and other issues that were still pending.
This new appeal for reconsideration focuses on a matter “on which the courts have already ruled, which issued a favorable ruling to the La Orotava City Council regarding the execution of this guarantee,” explained the councilor. “Therefore, in the report of the legal services that is raised in plenary session, the debate on the substance of the breach is not re-entered, which we believe is clear and manifest. All the allegations presented are rejected, except one that, due to a question of form, we are going to accept, since it is an error in a legal reference, “he advanced.
Mayor, Francisco Linares (CC) regretted that the promoter continues to present appeals when it considers it “evident” that they did not comply with their obligations for about 12 years and that, in addition, they have dedicated themselves to putting “all possible impediments” during this time. «The collaboration that we have found on the part of this company has been nil. Zero. We have unanimously wanted to insist on saying no to this company and on sticking to the legal arguments that we have defended regarding this matter for many years now, “Linares said.
